Utah Final Paycheck & Wage Payment

Utah's wage rules are mostly federal-floor, with one big exception that trips up employers: when you fire someone, final pay is due remarkably fast.

The 24-hour rule on termination

On an involuntary separation, all unpaid wages are due within 24 hours (Utah Code § 34-28-5) — among the strictest deadlines in the country. If the employee quits, final wages are due by the next regular payday.

The continuing-wage penalty

If the employer fails to pay within 24 hours of the employee's written demand, the employee's wages continue to accrue at the same rate for up to 60 days as a penalty. That makes a late final check on a discharge potentially very expensive.

Regular paydays

Wages must be paid at least semimonthlyand within 10 days after the close of a pay period (Utah Code § 34-28-3). Unauthorized deductions are prohibited.

Practical takeaways

Plan terminations so the final check (including all earned wages) is ready to hand over within 24 hours, never delay it to collect equipment or a signed release, and have the check pre-cut before the meeting whenever you can. The 24-hour clock is the single most-missed Utah rule.
